Terms & Conditions

Welcome to New England Siding. These Terms and Conditions ("Terms") govern your access to and use of our services, including consultations, installations, and any other services we offer (collectively, the "Services"). By engaging with our Services, you agree to comply with and be bound by these Terms.

1. Definitions

  • Company: Refers to New England Siding.

  • Client: Refers to the individual or entity requesting Services from the Company.

  • Services: Encompasses all consultations, installations, maintenance, and other work provided by the Company.

  • Agreement: Refers to the contractual agreement between the Company and the Client, including these Terms and any other documents incorporated by reference.

2. Acceptance of Terms

By using our Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using our Services.

3. Services Offered

New England Siding specializes in:

  • Siding Installation (Vinyl, Cedar Impressions, Fiber Cement)

  • Custom Windows and Doors

  • Roofing Services

  • Seamless Gutters and Gutter Guards

All Services are subject to availability and may be modified or discontinued at any time.

4. Estimates and Quotations

  • Initial Estimates: All initial estimates provided are non-binding and subject to change upon further inspection and assessment.

  • Final Quotation: A detailed quotation will be provided after a thorough evaluation of the project site. This quotation is valid for 30 days from the date issued.

  • Acceptance: Acceptance of the quotation must be in writing, either via email or signed agreement, to proceed with the Services.

5. Payment Terms

  • Deposit: A deposit of 30% of the total project cost is required upon acceptance of the quotation.

  • Progress Payments: Depending on the project's scope, progress payments may be required at agreed-upon milestones.

  • Final Payment: The remaining balance is due upon completion of the project and satisfactory final inspection.

  • Financing: Financing options are available through Enhancify. Approval is subject to Enhancify's terms and conditions.

  • Late Payments: Late payments may incur a fee of 1.5% per month on the outstanding balance.

6. Scheduling and Delays

  • Project Timeline: Estimated start and completion dates will be provided but are subject to change due to weather conditions, material availability, or unforeseen circumstances.

  • Delays: The Company is not liable for delays caused by factors beyond its control, including but not limited to acts of God, strikes, or supplier issues.

  • Communication: Clients will be informed promptly of any significant changes to the project schedule.

7. Client Responsibilities

  • Access to Property: The Client must provide the Company with reasonable access to the property during normal working hours.

  • Permits and Approvals: Unless otherwise agreed, the Client is responsible for obtaining any necessary permits or approvals required for the project.

  • Utilities: The Client must identify and inform the Company of any underground utilities or hazards on the property.

8. Warranties

  • Workmanship Warranty: The Company offers a 5-year warranty on all installation workmanship from the date of project completion.

  • Material Warranty: Materials are covered by the manufacturer's warranty. The Company will facilitate any claims but is not responsible for the manufacturer's terms.

  • Exclusions: Warranties do not cover damage due to misuse, neglect, alterations by others, or Acts of God.

9. Limitation of Liability

  • Indirect Damages: The Company is not liable for any indirect, incidental, or consequential damages arising from the Services.

  • Maximum Liability: The Company's total liability shall not exceed the total amount paid by the Client for the Services rendered.

10. Insurance

The Company is fully insured and maintains comprehensive liability and workers' compensation insurance. Proof of insurance is available upon request.

11. Termination

  • By Client: The Client may terminate the Agreement with written notice. The Client is responsible for payment for all Services rendered up to the termination date.

  • By Company: The Company reserves the right to terminate the Agreement for non-payment or breach of these Terms by the Client.

12. Intellectual Property

All materials, designs, plans, and documents provided by the Company remain the intellectual property of the Company and may not be used or reproduced without written consent.

13. Privacy Policy

The Company's use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising under these Terms shall be resolved through good faith negotiations. If unresolved, disputes shall be submitted to mediation before any legal action is taken.

16. Changes to Terms

The Company reserves the right to modify these Terms at any time. Changes will be effective upon posting on our website. Continued use of our Services constitutes acceptance of the modified Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, along with any written agreements or documents expressly incorporated herein, constitute the entire agreement between the Client and the Company regarding the Services.
